Terms of Service

These Terms of Service ("Terms") govern your use of MercaPic ("the Service"), an AI-powered e-commerce product photography tool. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Accounts

To use the Service you must create an account using a valid email address. You are responsible for all activity under your account. Do not share credentials. Notify us immediately of unauthorized access at fangzihao8831@gmail.com.

2. Acceptable use

You agree not to:

• Upload content you do not have the right to use, including copyrighted product photos belonging to someone else, or images depicting identifiable people without consent
• Generate content that infringes trademarks, depicts illegal activities, sexually explicit material involving minors, real political figures in misleading contexts, or violates third-party rights
• Reverse engineer, scrape, or automate the Service outside the documented API
• Resell Service outputs as AI art services competing with MercaPic
• Use the Service in applications requiring government, medical, or legal accuracy (the Service produces stylized marketing visuals, not factual records)

We may suspend or terminate accounts that violate this section.

3. Credits and billing

The Service operates on a credit system. Each generated image consumes credits. Failed generations do not consume credits. Credits are granted by your subscription tier:

• Free: 20 credits per month, personal use only, no commercial license
• Pro: 500 credits per month, commercial license, $19/month
• Team: 2 000 credits per month, commercial license, team seats, $49/month

Paid subscriptions renew automatically until cancelled. You may cancel anytime from your account settings. Cancellations take effect at the end of the current billing cycle. Unused credits expire one cycle after they are granted on paid tiers; Free-tier credits do not carry over.

4. Intellectual property

4.1 Your content

You retain ownership of product photos and briefs you upload ("Your Content"). You grant MercaPic a worldwide, non-exclusive license to process Your Content solely to provide the Service (storage, AI analysis, image generation). We do not use Your Content to train public models.

4.2 Generated output

Images generated by the Service ("Output") are assigned to you upon generation, subject to:

• Pro and Team plans: You receive full commercial rights to Output, including use in advertising, packaging, product listings, and resale. No attribution required.
• Free plan: Output is for personal and evaluation use only. Commercial use requires an upgrade.

Because AI-generated images may not be copyrightable in all jurisdictions, MercaPic makes no warranty of exclusive IP rights over Output.

4.3 Our platform

The MercaPic name, logo, interface, and underlying software are the intellectual property of MercaPic. You may not copy, modify, or create derivative works of the platform itself.

5. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee that generated images will match your exact vision, be free of artifacts, be unique from similar outputs for other users, or be suitable for any particular purpose. AI image generation can produce unexpected results; preview Output before publishing.

6. Limitation of liability

To the maximum extent permitted by law, MercaPic's total aggregate liability for any claim arising out of these Terms or the Service is limited to the amount you paid us in the twelve (12) months preceding the claim, or USD 50, whichever is greater. MercaPic is not liable for indirect, incidental, consequential, or punitive damages, including lost profits or reputational harm.

7. Termination

You may delete your account anytime from your Studio settings. We may suspend or terminate accounts for violation of these Terms, non-payment, or if required by law. Upon termination, uploaded photos are permanently deleted within 30 days; Output metadata (prompts, thumbnails) is retained for up to 90 days for fraud prevention and then deleted.

8. Changes

We may update these Terms. Material changes will be announced by email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.

9. Governing law

These Terms are governed by the laws of Spain (Kingdom of Spain), without regard to conflicts of law rules. Disputes are subject to the exclusive jurisdiction of the courts of Barcelona, Spain.
